RAPE

CONTACT US AT 703.542.4500

What is Rape?
In Virginia, Rape (Va. Code § 18.2-61) is defined as having sexual intercourse with the victim either (1) against the victim's will, by force, threat or intimidation, or (2) through the use of the victim's mental incapacity or physical helplessness, or (3) with a child under the age of 13.

A violation of rape carries with it very significant consequences. If found guilty of rape, the defendant faces confinement in prison for a minimum of 5 years to a maximum life term. There are several penalty enhancements associated with having sexual intercourse with a child under the age of 13 that include a minimum mandatory sentence of life.

To make matters more difficult, there are specific nuances in the Code which deal with evidence that can be introduced in a rape trial, including the Virginia Rape Shield Statute (Va. Code § 18.2-67.7). These nuances must be considered with an experienced Virginia defense attorney in order to formulate a defense strategy which best suits the particular defendant.

What should I do if I am charged with Rape in Virginia?
Rape is a very serious offense and will likely make getting a job, security clearance, and other goals far more difficult to accomplish. Just being charged with this offense can ruin families and ruin your reputation in your community. A conviction labels the defendant a "convicted felon" and places the defendant on the sex-offender list for the duration of the defendant's life.  It is critical that you have legal representation from the outset of the process.

Mr. Noorishad understands your concerns and the gravity that a rape charge may have in your life.  While results will vary depending on the facts of each individual case, Mr. Noorishad has successfully represented adult and juvenile clients to acquittal or dismissal in multiple counties throughout Northern Virginia for charges such as Rape, Aggravated Sexual Battery, Prostitution-Related offenses and Object Sexual Penetration, among others.
