INDECENT EXPOSURE

A violation for Indecent Exposure under Virginia Code § 18.2-387 is committed when a person intentionally makes an obscene display or exposure of his private parts in a public place or a place where others are present. A place where others are present includes a privately owned, secluded place if the defendant's activities are observable by another person; the exposure does need not actually be observed by a person at whom it is directed in order for the defendant to be convicted of Indecent Exposure. 

Indecent Exposure is a Class 1 misdemeanor, which is punishable by up to 12 months in jail and a $2,500.00 fine.

To convict, the Commonwealth must first prove that the defendant displayed or exposed his private parts. The Commonwealth must also prove that the display or exposure was intentional.  Finally, the exposure or display must also be proven to be "obscene", as defined in Va. Code § 18.2-372.
